Choosing Formation Agents in Germany
Company formation in Germany is not something an agent can complete on your behalf end to end: forming a GmbH or UG legally requires a German notary to notarise the articles of association, and registration in the Handelsregister (commercial register) through the court. Notary and register fees are fixed nationwide by the Court and Notary Fees Act (GNotKG), so they do not vary between providers.
A “formation agent” in Germany is therefore a coordinator, not a regulated office-holder: they prepare documents, arrange the notary appointment, handle the registered address and the trade-office (Gewerbeanmeldung) and tax registrations, and often bundle bookkeeping. What to compare: exactly which steps are included versus billed separately, whether the quoted price excludes the statutory notary and register fees (it usually does), and whether they can act for a foreign founder who cannot attend the notary in person.
